  • This Privacy Policy describes how Hawley-Lambert, Inc., doing business as EVOC Sports US, and Cycles Lambert Inc., doing business as EVOC Sports Canada (collectively, “EVOC,” “we,” “us,” or “our”), collect, use, disclose, and otherwise process personal information when you: 

  • Visit or interact with EvocSports.us and EvocSports.ca; 

  • Purchase or inquire about our products; 

  • Create or use a customer account; 

  • Subscribe to our marketing communications; 

  • Contact customer service; 

  • Participate in a promotion, survey, event, warranty program, or product registration; or 

  • Otherwise interact with us.

2. Personal Information We Collect 

Information You Provide 

  • Contact information, including your name, email address, telephone number, billing address, and shipping address. 

  • Account information, including login credentials, account preferences, and purchase history. 

  • Order information, including products purchased, order value, delivery information, returns, warranties, and transaction history. 

  • Payment-related information. Payments are processed by Shopify and our payment providers. We generally do not directly store complete payment-card numbers. 

  • Customer-service information, including messages, warranty claims, returns, product questions, photographs, and other information you provide. 

  • Marketing preferences, including newsletter subscriptions and communication preferences. 

  • Promotion and survey information, including contest entries, responses, and feedback. 

  • Any other information you choose to provide. 

Information Collected Automatically 

When you use our website, we and our service providers may automatically collect: 

  • Internet Protocol address; 

  • Browser, operating-system, and device information; 

  • Cookie and similar-technology identifiers; 

  • Pages and products viewed; 

  • Searches and interactions with the website; 

  • Referring and exit pages; 

  • Approximate location derived from your IP address; 

  • Shopping-cart activity; 

  • Advertising interactions; and 

  • Dates, times, and duration of visits.

Where consent is required, you may withdraw it subject to legal and contractual restrictions. Withdrawal does not affect processing that occurred lawfully before consent was withdrawn. 

4. Cookies, Analytics, and Advertising 

We use cookies, pixels, tags, software development kits, and similar technologies to operate the website, remember preferences, understand website activity, prevent fraud, and support advertising. 

These technologies may include: 

  • Essential technologies needed for checkout, account access, security, and website operation; 

  • Functional technologies that remember choices; 

  • Analytics technologies that measure website usage; and 

  • Advertising technologies that measure campaigns or provide targeted advertising. 

Our current providers may include: 

  • Shopify; 

  • Google Analytics 

  • Meta/Facebook 

  • Google Ads 

  • Klaviyo 

 

You can manage non-essential technologies through the cookie-preference tool available on our website. You can also adjust browser settings, although disabling essential cookies may prevent parts of the website from working. 

 

Where required by law, advertising or profiling technologies will not be activated until you provide the required consent. 

5. How We Disclose Personal Information 

We may disclose personal information to: 

  • Shopify, which hosts and operates our ecommerce platform; 

  • Payment processors and financial institutions; 

  • Shipping, warehousing, logistics, and fulfillment providers; 

  • Customer-service and warranty providers; 

  • Cloud-hosting, information-technology, and security providers; 

  • Analytics providers; 

  • Marketing and advertising providers; 

  • Email and communication providers; 

  • Professional advisers, including lawyers, accountants, insurers, and auditors; 

  • Government, regulatory, law-enforcement, or other parties when required or permitted by law; 

  • A purchaser, investor, lender, or adviser involved in a proposed or completed business transaction; and 

  • Other parties with your consent or at your direction. 

These organizations may process information on our behalf or, in some circumstances, for their own disclosed purposes. 

We do not permit service providers acting solely on our behalf to use personal information for unrelated purposes. 

6. Targeted Advertising and Sale or Sharing 

We may disclose identifiers, internet activity, commercial information, and advertising information to advertising partners for cross-context behavioral or targeted advertising. 

We do not sell personal information for money. However, some U.S. privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include certain advertising-related disclosures. 

You can opt out through: 

  • The Your Privacy Choices link in our website footer; 

  • Our cookie-preference tool; 

  • A recognized browser-based universal opt-out signal, such as Global Privacy Control, where required; or 

  • The contact methods in Section 14. 

Our website does not currently respond to browser-based “Do Not Track” (DNT) signals, which are separate from recognized universal opt-out signals such as Global Privacy Control. 

We do not knowingly sell or share personal information belonging to individuals under 16 years of age. 

7. International and Cross-Border Processing 

We and our service providers may process or store personal information in the United States, Canada, and other jurisdictions where our service providers operate. 

 

As a result, information may be subject to the laws of those jurisdictions and may be accessible to courts, law-enforcement agencies, or governmental authorities in accordance with applicable law. 

We use contractual, organizational, and technical measures designed to protect personal information when it is processed outside your province, state, or country. 

Québec residents can contact our Privacy Officer for additional information about processing outside Québec. 

8. Retention 

We retain personal information only for as long as reasonably necessary to: 

  • Complete the purposes described in this policy; 

  • Maintain our relationship with you; 

  • Fulfill warranties and customer-service obligations; 

  • Meet legal, tax, accounting, and regulatory requirements; 

  • Resolve disputes; 

  • Enforce agreements; and 

  • Protect against fraud and security incidents. 

We determine retention periods based on the nature and sensitivity of the information, the purposes for which it is processed, warranty and customer-service requirements, and applicable legal, accounting, tax, fraud-prevention, and dispute-resolution obligations. 

After the applicable period, we delete, anonymize, or securely destroy the information unless continued retention is required or permitted by law. 

9. Security 

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, collection, use, disclosure, alteration, loss, or destruction. 

No method of transmission or storage is completely secure. We therefore cannot guarantee absolute security. 

If you believe your account or personal information has been compromised, contact us promptly using the information in Section 14. 

Data Breach and Security Incident Notification 

If we become aware of a security incident involving personal information, we will investigate and take reasonable steps to contain and remediate the incident and reduce the risk of harm. Where required by applicable law, including when an incident presents a real risk of significant harm or serious injury, we will notify affected individuals and applicable regulators or other authorities within the legally required timeframe. We will also maintain records of the incident and provide information about protective steps when required by law. 

10. Marketing Communications 

We may send promotional communications when permitted by law or when we have obtained the required consent. 

You can unsubscribe from promotional emails by selecting the unsubscribe link in the message or contacting us. You may continue receiving non-promotional communications concerning orders, accounts, warranties, security, or other transactions. 

11. Children’s Privacy 

Our website and products are intended for a general audience and are not directed to children under 13. 

We do not knowingly collect personal information online from children under 13 without legally valid parental consent. If you believe a child has provided personal information to us improperly, contact our Privacy Officer so we can investigate and take appropriate action. 

Where a higher age threshold applies under local law, we will comply with that requirement. 

12. United States Privacy Rights 

Depending on your state of residence and whether the applicable law covers our business, you may have the right to: 

  • Confirm whether we process your personal information; 

  • Access or obtain a copy of your personal information; 

  • Correct inaccurate personal information; 

  • Delete personal information; 

  • Obtain certain information in a portable format; 

  • Opt out of the sale or sharing of personal information; 

  • Opt out of targeted advertising; 

  • Opt out of certain profiling producing legal or similarly significant effects; 

  • Limit certain uses or disclosures of sensitive personal information; 

  • Withdraw consent where processing is based on consent; and 

  • Receive equal service without unlawful discrimination for exercising your rights.

Response times. We will respond to privacy rights requests within the timeframe required by applicable law. Depending on the request and jurisdiction, the initial response period is generally 30 to 45 days, and certain opt-out requests may require faster action. If additional time is reasonably necessary and an extension is permitted by law, we will notify you within the initial response period, explain the reason for the extension, and provide the expected response date. 

 

We will verify your request using information reasonably related to your previous interactions with us. We will use information submitted with the request only to verify and respond to it. 

You may use an authorized agent where permitted by law. We may require proof of the agent’s authority and may ask you to verify your identity directly. 

 

If we deny all or part of your request, you may appeal our decision by emailing info@evocsports.us for U.S. requests or info@evocsports.ca for Canadian requests with the subject line “Privacy Request Appeal.” Please include enough information for us to identify your original request. 

California Disclosures 

This section applies if the California Consumer Privacy Act applies to our business. 

During the preceding 12 months, we may have collected the following categories of personal information: 

  • Identifiers; 

  • Customer-record information; 

  • Commercial information; 

  • Internet or electronic-network activity; 

  • Approximate geolocation information; 

  • Audio, electronic, or visual information submitted through customer service; 

  • Inferences derived from other information; and 

  • Sensitive personal information, such as account credentials or payment-related information, when applicable. 

We collect these categories from the sources described in Section 2, use them for the purposes described in Section 3, and disclose them to the recipients described in Section 5. 

We do not sell personal information for money. We may share identifiers, internet activity, commercial information, and advertising information for cross-context behavioral advertising, as described in Section 6. 

 

We use and disclose sensitive personal information only for purposes permitted by applicable law, such as processing orders, preventing fraud, and maintaining account security. 

 

California residents can exercise their rights using the methods above. We will not unlawfully discriminate against you for exercising a privacy right. 

13. Canadian Privacy Rights 

If you are in Canada, you may request: 

  • Access to personal information we hold about you; 

  • Information about how it has been used and disclosed; 

  • Correction of inaccurate or incomplete information; and 

  • Withdrawal of consent, subject to legal and contractual restrictions. 

You may also ask questions or make a complaint about our privacy practices. 

Requests must be submitted to our Privacy Officer using the contact information in Section 14. We may need to verify your identity before responding. 

Response times. We will respond to privacy rights requests within the timeframe required by applicable law.
